EPA for Region 3 has announced a Process Change to notifications. They state:

"The process of sending required asbestos notifications to both the delegated state/local authority and EPA Region 3 has been changed. Complete and timely notifications must be sent to the state or local authority where the work is occurring, but they do not need to be sent to EPA. This applies to any demolition or renovation work occurring in Pennsylvania, including Allegheny County and Philadelphia; Delaware; Maryland; West Virginia: and Virginia. For any demolition or renovation work occurring in the District of Columbia, asbestos notifications are still required to be sent to both DC and EPA Region 3."

    Change in Ohio Asbestos Rule

Effective on January 31, 2021, Ohio’s asbestos regulation (Ohio Asbestos rule 3745-22) has been revised. Highlights of the rule include changing of the definition “Asbestos hazard abatement activity” from 50 l/ft. or 50 sq/ft. of friable asbestos to 3 l/ft. or 3sq/ft. of friable ACM. The definition of “Asbestos hazard abatement project” is now 50 l/ft. or 50 sq/ft. of friable ACM.

An “Asbestos hazard abatement project” includes any such activity involving such friable ACM in an amount of 50 l/ft. or 50 sq/ft. or less if, when combined with any other reasonably related activity in terms of time or location of the activity, the total amount is in an amount greater than 50 l/ft. or 50sq/ft.

    New PA DEP Notification requirements

    Per DEP:

Notice: Effective January 16, 2021, all initial Asbestos Notifications must be accompanied a $300 fee. Initial notifications will not be considered complete unless accompanied by the fee. This fee does not apply to revisions of notifications. The Saturday, January 16, 2021 effective date is the result of a three-year regulatory process and will be finalized upon publication in the Pennsylvania Bulletin on that date. This fee will help address the long-term disparity between revenue and expenditures in DEP’s Air Quality Program. Further information can be found here:
